There are many forms of sexual harassment. The definition of sexual harassment is: unwelcome sexual advances, requests for sexual favors and / or other verbal or physical conduct of a sexual nature that affects an individual's employment, interferes with an employee's work performance or creates an intimidating, hostile or offensive work environment. Reporting this type of harassment is never easy. Some people feel strongly about this and it can divide the workplace. Half of the employees will say the individual is too sensitive and the other half may feel that it's about time someone stood up and said something. Sometimes it is the employee's supervisor who is the problem, making it even more difficult to report. Whether the case involves a new employee or the Vice President, your company's liability is at stake. Courts continue to hold employer's liable for their employee's conduct. Just recently in Detroit and California, employees filed suit against their employers for sexual harassment. In one of the cases, the plaintiff was awarded $1.7 million for pain and suffering and punitive damages. The other case is still pending. And locally, a sexual harassment suit was settled and the jury awarded the plaintiff's a combined total of $250,000.00. Many times when a claim of sexual harassment is made, employer's try to pass it off as the complainant is too sensitive or thin-skinned. Bottom line, if you are offended by another employee's actions, then they need to stop. If the employee let's either management and / or the offender know that what is being done is offensive and neither party stops the behavior, where do you turn?
